date error while searching for a patient based on criteria

after logging into system,on homepage user selects Cohort Builder tab
1.User enters 'Failure' in Search by Concepts and Observations text box under Concept/observation tab in Cohort Builder page
2.User clicks on 'Failure to thrive' hyperlink from the list available
3.User selects Patients who have these observations
from the drop down, selects the date as 16/11/2012 in date range box from calendar and click on search button
4.here system trying to search for the patients and showing the result as '0'

Expected result
System should show the error message as the date being selected is of future date
Actual result
system trying to search for the patients and showing the result as 'zero'

System should not allow the user to search for obsdatetime in the future.
